The AI Governance Market Has a Governance Problem

I’ve been watching the AI governance market fill up with products that have governance in the name and policy enforcement in the code.

This isn’t a minor distinction. It’s the whole problem.

A few weeks ago, I posted an article about what real AI governance requires. Someone responded in the comments. Short version: “Your product does this. But ours is substantially better because of [concept].” The concept they described was something we’d built. They just called it something else. The part that was genuinely funny: they clearly hadn’t read the article carefully enough to notice I’d already addressed it, and hadn’t researched Nomotic enough to realize they were describing a subset of what we’d already shipped.

This is governance washing. And it’s everywhere.

What Governance Washing Looks Like

Last week, someone posted an infographic. The framework went: Agent Intent -> Authority Layer -> Policy Engine -> Execution Gate -> Verification -> Observability -> Accountability -> System Mutation.

Here’s what that actually is. The authority layer, policy engine, and execution gate are the same thing drawn three times. They’re all policy enforcement at different points in the call stack. Verification and observability are an access log with a dashboard on top. Accountability, in this context, means you saved the log.

There’s no agent identity. There’s no behavioral memory. There’s no concept of trust that changes based on what the agent actually does over time. There’s nothing that explains why the agent did what it did or evaluates whether that behavior was appropriate given everything the agent has done before.

It’s policy enforcement with an access log. That’s not governance. That’s a firewall with extra steps.

The Enforcement Trap

I want to be clear that enforcement is definitely a part of governance. You need enforcement. Nomotic has enforcement. The mistake is thinking enforcement is the whole thing.

What the market is doing right now is placing policy enforcement at every stage of the lifecycle and calling it a governance platform. Pre-deployment: policy enforcement as execution boundaries. In-flight: policy enforcement as decision trees for actions. Post-execution: policy enforcement of audit trails. Stack those three up on a slide deck, and you have a governance narrative.

What you don’t have is governance.

Because actual governance is much more challenging than policy enforcement. It’s a hard problem to solve. Much easier to talk about.

The question enforcement can’t answer is: should the agent have done that? Not whether it was allowed. Not whether it passed through the gate. Whether the action was appropriate given the agent’s behavioral history, the context of the session, the trust trajectory, the stakeholder impact, human complacency, drift mitigation, the organizational values in effect at the time, and provide a verifiable response as to the reasoning.

Enforcement tells you what happened. Governance tells you whether it should have.

Agent Washing by Another Name

The industry went through agent washing. Everything became an agent. Chatbots, workflows, scheduled scripts, and all agents. The word lost meaning before it finished gaining it.

The same thing is happening to governance. Every output filter, every policy engine, every audit logger is now a governance platform. The word is being hollowed out in real time. And buyers are being trained to accept the hollow version because it comes in a polished demo.

Speaking of demos: the vaporware problem is getting worse. Scripted scenarios. Hardcoded responses. No real LLM. No real evaluation engine. The demo passes because the demo was built to pass.

Real governance doesn’t pass because it was built to pass. It either governs correctly or it fails visibly. That’s actually what you want.

What Governing an Agent Actually Means

Let me put a stake in the ground. Governing an AI agent means managing that agent across its full lifecycle, responding to its actual behavior, and producing a justifiable record of every decision made about it. Not just what it was allowed to do. What it actually did, why that was appropriate or not, and how that affects what it’s allowed to do next.

That requires more than a policy engine. It requires the full surface area of what an agent is.

Nomotic includes:

Agent Identity. Who is this agent, cryptographically, before it takes a single action? Not a name in a config file. A signed, verifiable birth  certificate that binds identity to a behavioral contract.

Agent Configuration. What is this agent supposed to do. Not just permissions. A behavioral contract that defines expected patterns, risk tolerance, and operational scope.

Agent Discovery. Where does this agent exist, rogue unidentified agents, and what is it authorized to reach. Governance zones that define operational boundaries before execution starts.

Agent Tracking. What has this agent done. Not a log. A behavioral fingerprint built from every action, every target, every timing pattern. A baseline that defines what normal looks like for this specific agent.

Agent Management. What happens when something changes. The ability to suspend, modify, rehabilitate, or terminate an agent in response to observed behavior, not just policy violations.

Agent Security. Adversarial protection. Prompt injection detection. Manipulation resistance. The ability to recognize when someone is trying to use the agent against its own governance.

Agent Policies. The actual behavioral contracts. Not just rules. Weighted constraints that account for context, precedent, and organizational values.

Agent Drift Protection. Bidirectional drift detection. The agent’s behavior drifts. Human reviewers drift too. Both need to be detected and trigger a response.

Agent Certification. A birth certificate that establishes identity, behavioral baseline, archetype, and governance zone at initialization. A governance seal on every verdict that can be verified by anyone downstream.

Agent Audits. Hash-chained, tamper-evident records of every governance decision. Not just what was allowed. What was evaluated, across every dimension, and why the verdict landed where it did. Counterfactual replay so you can answer the question “what would have happened if.”

Agent Analytics. Behavioral intelligence across the fleet. Trust trajectory. Dimension-level scoring patterns. Drift signatures. The ability to see not just what agents did but how the population of agents is behaving over time.

Agent Authorization. Real-time, multidimensional evaluation of every action before consequences happen. Twenty dimensions are evaluated simultaneously. Trust-weighted scoring. A three-tier cascade that escalates to probabilistic reasoning and human review when deterministic rules aren’t sufficient.

Agent Behavior. Adaptive trust that evolves with every action. Behavioral memory that informs every new evaluation. The agent’s history is a governance input, not just a log.

Agent Accountability. Reasoning artifacts. Structured externalization of the agent’s deliberation so governance can evaluate not just what was done but how the decision was reached.

Agent Packaging. The open standard for packaging, signing, and certifying AI agents. Manifest, integrity hash, and behavioral trust score in a single portable .agent file.

And more….

That’s what governing an agent looks like. Not a policy gate. Not an access log.

This Is What We Built

Still operating in ways that expose your organization to liability, a policy engine will never catch because policy engines don’t have behavioral memory. They don’t know what the agent did last week. They just know whether this specific action is on the list.

The Question to Ask

The next time you see a governance platform demo, ask this: Can it tell you why the agent made the decision it made, evaluate whether that decision was appropriate given the agent’s behavioral history, and adjust how that agent is governed in real time based on what it observes?

If the answer is no, you’re looking at policy enforcement. Which is useful. Which Nomotic also has.

But it’s not AI Governance.
