5 Reasons AI Governance Built Today will be Obsolete in 5 Years

Building AI governance right now feels urgent. The regulatory requirements are arriving, the incidents are accumulating, and the organizations that have nothing will be exposed when the examinations begin.

But here is what almost no one in the governance conversation is acknowledging. The infrastructure being built today is being built for a version of AI that will have evolved beyond recognition in five years. The concerns being addressed are real. The solutions being deployed will be partially obsolete before they are fully implemented.

That is an argument for building governance now, with clear eyes about what is being built. It is an argument for building with the awareness that you are building for a moving target, and that the governance debt of tomorrow may look very different from today’s.

Here are five reasons why.

1. LLMs Will Stop Being the Only Option

Ninety-nine percent of the AI governance conversation today centers on large language models. The probabilistic evaluation problem, the hallucination risk, the deterministic wrapper paradox, and the compounding uncertainty of LLM-over-LLM governance. All of it assumes an LLM at the center of every agentic system.

LLMs will improve significantly. Hallucinations will persist, but accuracy will continue to climb. The infrastructure around LLMs (context management, output validation, retrieval architectures) will reduce the practical frequency of the failure modes that governance frameworks are currently designed to catch. The systems that require the most governance attention today will require less of the same kind of attention in five years.

More importantly, LLMs will cease to dominate agentic AI architecture. New deterministic model architectures are already in development. Purpose-built models for specific domains. Hybrid systems that use probabilistic reasoning only where it is actually needed and deterministic logic where predictability is required. The agentic systems of 2030 will likely operate on architectures that bear little resemblance to LLM-centered design.

A governance framework designed for probabilistic LLM behavior will be misaligned with deterministic or hybrid systems that require a different kind of governance. The evaluation dimensions that matter for an LLM map poorly onto an architecture that reasons differently. The behavioral contracts that make sense for a generative system make less sense for a system that produces bounded, verifiable outputs.

The governance frameworks being built now are built for today’s dominant architecture. That architecture is changing.

2. Governance Will Be Baked Into the Protocol

The second reason today’s governance will be obsolete is that the problems it addresses will be solved at a lower layer.

Protocols like Agent Transfer Protocol (AGTP) are being developed to make governance primitives (agent identity, trust signals, authority scope, attribution records) native to the infrastructure rather than applying them from the outside. When agent identity is a wire-level fact rather than an application-layer assertion, the governance products designed to manage it become redundant. When trust signals travel within the protocol envelope, the platforms that generate and maintain them lose their primary differentiator.

Shadow agents, one of the most cited governance concerns today, disappear as a concept when every agent on a standardized protocol carries a verifiable identity, and traffic lacking that identity is structurally identifiable as ungoverned. The concern evolves into different and more complex territory.

What replaces it is the governance problem of the agentic web: spam, abuse, privacy violations, and adversarial behavior by agents with valid identities and legitimate authority who, nonetheless, act against human interests in their transactions. In the same way email governance evolved from identity verification to spam filtering to phishing detection to content policy enforcement, agent governance will evolve from identity establishment to behavioral policy to adversarial pattern detection.

Today’s governance frameworks address the identity and authorization layer. Tomorrow’s will address the behavioral and adversarial layer. The infrastructure being built now addresses layer one of a multi-layer problem. The foundational layer. Still only the first.

3. Agents Will Develop Continuity

Most agents today are disposable. Spin one up, complete a task, tear it down. Agents have no meaningful continuity across sessions, no accumulated history that matters, no persistent identity that develops over time. The governance questions they generate are transactional. Did this agent have authorization? Did this action fall within scope? What did the audit trail record?

This will change fundamentally within five years.

Agents that persist, accumulate experience, develop behavioral patterns over extended operation, learn from interactions, and build something that functions like institutional knowledge are already being developed. When an agent has been operating continuously for two years, has developed patterns that reflect the organization’s culture and priorities, and represents a meaningful asset in how work gets done, the governance questions become much more complex.

Think about how we relate to persistent characters in games, in long-running software tools, in anything that develops alongside us over time. Agents that develop continuity will develop something like identity in the functional sense, yet with accumulated behavioral character that matters and that changes how they are treated.

Governing a disposable agent is a transaction governance problem. Governing a persistent agent with two years of operational history, accumulated trust, and behavioral patterns that reflect real organizational learning is a relationship governance problem. The frameworks are different in kind. The audit trail that matters for a disposable agent is a session record. The audit trail that matters for a persistent agent is a behavioral biography.

The governance infrastructure being built now fails to account for agent longevity because agents have not yet lived long enough for it to matter. They will be.

4. AI Will Become Portable and Personal

The AI governance conversation is currently framed around organizational deployment. A company deploys AI. A government deploys AI. A regulated entity deploys AI. The governance addresses the impact on consumers, employees, and the public. The accountability chain runs through organizations with legal personhood and governance obligations.

This frame is becoming incomplete.

AI is moving toward the edge. Nano language models that run on devices. Embedded AI in wearables, in homes, in physical objects. Personalized models that develop alongside individual users rather than serving organizational functions. AI applications that communicate with other AI applications the way Bluetooth connections operate : local, automatic, peer-to-peer, outside the organizational governance stack entirely.

When AI is disconnected from organizational infrastructure, the accountability chain that current governance frameworks rely on becomes genuinely difficult to establish. A structural gap that surfaces at the worst possible moment. Who is responsible for the behavior of a personalized model running entirely on a user’s device, trained on that user’s data, making decisions that affect that user’s life? The organization that manufactured the device? What platform provided the model architecture? The user who configured the personalization? The regulatory frameworks built around organizational accountability map poorly onto personal AI that operates outside organizational control.

The governance demands of embedded, portable, personal AI differ from those of organizational AI deployment. The frameworks being built now address the latter. The former is arriving without an adequate governance framework.

5. Understanding Will Finally Catch Up

The fifth reason today’s governance will be obsolete is the most optimistic one.

The governance frameworks being built now are emerging amid profound collective confusion about what AI actually is. Organizations are governing imagined capabilities rather than actual ones, a belief problem as much as a technical one. Regulatory frameworks are written for systems still in formation. Products solve problems created by misunderstanding the technology. The belief gap , the distance between what AI can technically do and what people believe it can do, is driving governance decisions that will look strange in retrospect.

In five years, the understanding of AI will have improved substantially. The technology will be no simpler, but because enough time will have passed and enough incidents will have occurred that the field will have genuine empirical grounding for what AI systems actually do, how they actually fail, and what governance actually prevents.

The governance that works will be understood to work because there is evidence. The governance theater will be understood to be theater because the incidents it was supposed to prevent happened anyway. The vocabulary will be more settled. The regulatory requirements will be more specific. The liability landscape will have been shaped by real cases with real outcomes.

Today’s AI governance is being built during the peak of the hype cycle, before the correction that produces clarity. The governance that gets built after that correction will be better informed, more precisely targeted, and more honest about what it can and cannot do.

Which means the governance being built right now will, in five years, look like the first generation of enterprise security programs did after a decade of real threat intelligence replaced the initial assumptions. Directionally correct. Specifically wrong about many things. It is necessary to undergo the costly process of determining the real problem.

Bonus Question: What If AI Goes Away?

Any honest look at the future of AI governance has to acknowledge that scenarios include outcomes that sharply diverge from the current trend. I’m not saying AI goes away in the sense that it has been around for 40 years already, but more practical views of hype and focus will definitely shift. Similar to how you’re not reading articles today about building websites for a better customer experience.

AI winters are real and documented. The history of the field includes multiple periods of enthusiasm followed by disappointment and retreat. If a significant failure , a high-profile incident, a security breach at scale, or a societal reaction to a specific harm produces a credibility collapse, the AI governance conversation could cool substantially faster than anyone currently expects.

A competing technology could reorder priorities. Quantum computing is maturing to practical utility. Robotics is reaching the home. Brain-computer interfaces are reaching commercial viability. Any of these could absorb the attention and investment currently focused on AI, shifting governance concerns to new domains before the AI governance infrastructure has matured.

Or AI simply becomes ubiquitous and unremarkable. Infrastructure like electricity. The governance normalizes. The hype dissipates. The organizations that were waiting to understand AI find that it has become part of the operational fabric without their noticing. Human connection, physical presence, and the things that AI cannot replicate become differentiators rather than anachronisms.

In any of these scenarios, the governance frameworks being built now become historical artifacts rather than operational infrastructure. That is still a reason to build them. Every field builds on the infrastructure of previous generations, even when that infrastructure turns out to have been transitional.

Build the governance. Build it well. Build it knowing the target is moving faster than the building.
