The Governance Masquerade

I track somewhere between 40 and 50 runtime AI governance projects right now. I have been watching this space since before most of them existed. And it’s amazing how many believe they are the only ones out there.

Here is what I can tell you.

Most of them are doing the same thing. The terminology differs. The positioning differs. The branding is sometimes creative. The Claude Code markers are present. But when you look at what is actually running, the pattern is consistent. An evaluation layer that checks requests against a set of rules or a trained classifier. A logging mechanism. A dashboard. Marketing copy that uses the word governance eleven times in a paragraph.

They are all the same, and all flawed.

And then there are the organizations that are not even doing that. The ones that implemented IP allowlists and rate limits pointed at the access control documentation and told their compliance team they had AI governance. Or the ones whose AI governance program is a policy PDF in a shared drive that nobody has read since it was written eighteen months ago.

This is the Governance Masquerade. The practice of presenting security controls, output filters, policy documentation, or access management as AI governance, while lacking the behavioral evaluation, verified agent identity, tamper-evident audit trail, and runtime enforcement that governance actually requires. A governance masquerade satisfies the board conversation. It does not meet regulatory requirements for an incident investigation.

And it is going to cost people.

Why the Masquerade Works

Put aside the current agent washing issue we have. I argue that 99% of the things labeled as an “agent” are, in fact, just automation scripts, applications, or macros.

And I say this while building a platform specifically to manage agents. Well, at least in my view, the agents of the future. Not the scripts being marketed as agents today.

Between agents and governance, the industry is honestly a mess.

AI governance is currently in the masquerade phase. Governance has become a market expectation. Enterprises want it. Regulators are asking about it. Investors are asking about it. So products claim it. Organizations claim it. And the word has inflated to the point where it covers things that are not the same thing, evaluated as though they were.

The masquerade works because the distance between the claim and the test is still wide. As long as nobody is examining the evidence chain in detail, the policy document, the access controls, and the logging infrastructure feel like governance because nothing has happened to reveal the difference.

That distance is closing.

The Five Costumes

The Governance Masquerade is not one thing. It is a wardrobe. Five distinct costumes, each one worn with confidence, each one designed to look like governance from a distance.

The Access Control Costume. Security rebranded as governance. Access controls. IP allowlists. Rate limiting. Authentication and authorization frameworks. These are real and necessary. They are also security infrastructure, not governance infrastructure. Security asks whether an action is permitted. Governance asks whether it should happen. An organization with robust security but no governance has one layer, not two.

The Content Moderation Costume. Output filtering labeled as governance. A classifier that flags certain categories of output. A keyword blocklist. A toxicity scorer. These evaluate what an agent produced after the decision to act was already made. Governance happens before execution and addresses whether the action should proceed. Content moderation happens after execution and addresses whether the output is acceptable. Important work. Not the same work.

The Documentation Costume. Logs are presented as an audit trail. A log is a record of events. An audit trail is evidence. The difference is in tamper-evidence, hash chaining, and identity attribution that would hold up under forensic examination. Most governance products produce logs. Very few produce audit trails in any evidentiary sense.

The Compliance Costume. Policy documentation substitutes for policy enforcement. A written governance framework describes what should happen. A governance infrastructure enforces what does happen. These are not equivalent. An agent that violates its defined scope while the policy document says it should not have done so has not been governed. It has been documented.

The Evaluation Costume. An LLM evaluating whether an LLM should act. A real architectural choice with real tradeoffs. What it is not is a deterministic, evidence-producing governance layer. It is a probabilistic evaluation of probabilistic behavior, and the compounding uncertainty is a structural property that most products in this category are not being transparent about.

Why the Market Looks This Way

None of this is happening because people are building in bad faith. Most of the teams in this space are working on hard problems with genuine intent.

We are at the same moment when everyone was a “graphic designer,” then a “web designer,” followed by an “app developer.” Last year, they were “AI experts,” and this year, “AI governance architects.”

The market looks this way because governance is easier to claim than to build, and the buying signal rewards the claim more reliably than the substance. An organization that needs to tell its board it has AI governance will more readily buy a product labeled ‘governance’ than one that explains the architectural distinction between security controls and behavioral evaluation.

The 40 to 50 projects I am tracking have largely converged on a similar feature set because they are all responding to the same demand signal. A dashboard. An evaluation layer. A compliance report generator. A human review queue. These satisfy the board conversation. They satisfy the initial regulatory inquiry. They do not satisfy Article 12 of the EU AI Act under examination, nor do they produce the evidentiary audit trail that a legal proceeding or a serious incident investigation actually requires.

What Genuine Governance Requires

Genuine AI governance requires a stable, verified identity for every agent. Not a session token. Not an API credential. A persistent identity that binds the agent to a human owner and a governance context that can be independently verified.

It requires a behavioral contract that specifies what the agent is supposed to do, providing a baseline against which evaluation is meaningful. Evaluation without a specification is pattern matching against a model’s priors.

It requires runtime evaluation before execution, with the authority to halt execution if the verdict is DENY. An evaluation that produces a verdict and then observes the action proceed regardless is not governance. It is documentation with extra steps.

It requires a tamper-evident audit trail that cryptographically links every evaluation to the action it evaluated, the agent identity that was verified, and the human owner on record. The trail has to be independently verifiable. It has to be producible as evidence.

It requires behavioral drift detection that monitors patterns over time rather than just individual actions. A governance system that resets its context on every request cannot detect the slow behavioral shifts that represent compounding risk. Governance is temporal, not transactional.

These requirements align directly with what the EU AI Act, SOC 2, HIPAA, and serious incident investigations actually require.

The Masquerade Ends

Governance masquerades are comfortable until they are not. The EU AI Act enforcement is not theoretical. Article 9 requires continuous risk management with evidence. Article 12 requires record-keeping that can survive regulatory examination. Article 14 requires demonstrably operational human oversight.

When a regulator requests the continuous risk management documentation required under Article 9, a policy PDF will not be sufficient. When a legal proceeding seeks the audit record of an agent’s actions, log files that an administrator may have edited will not be sufficient. When an incident investigation needs to trace an action to a specific agent identity with a known owner and a known behavioral contract, an API key will not be sufficient.

Every masquerade ends. The only question is whether you are the one who chooses to remove the costume, or whether the examination does it for you.

The organizations that have built a genuine governance infrastructure will have what is required. The organizations wearing costumes will have a very expensive conversation about what they actually built and what it would have taken to build the real thing.

That conversation is easier to have before the incident than after.
