If You Don’t Know Who Your Agent Is, You Don’t Have Governance

There’s a question I ask when organizations tell me they’ve implemented AI governance.

Not about their evaluation framework. Not about their audit trail. Not about how they handle human escalation. I ask something more basic.

Do your agents have identities?

The Anonymous Agent Problem

Most AI agents in production today have no verifiable identity. They have API keys. Environment variables. Internal labels that exist in a config file somewhere. Names someone typed into a dashboard that have no cryptographic backing, no binding to a human owner, no chain of custody from the moment the agent was created to the moment it’s taking action.

And the problem is growing faster than most organizations realize. Analysts have projected that AI agents could outnumber humans on the planet by 2027. Not users of AI. Agents. Bits of code taking actions in the world. The ratio of non-human digital identities to humans in enterprise environments is already estimated at 50:1, and that number is accelerating.

The governance implications of that scale are only manageable if you know what you’re governing.

Which brings up the problem most enterprises are actively ignoring: shadow agents.

Shadow AI isn’t new. For years, employees have been spinning up unsanctioned SaaS tools, running personal ChatGPT accounts, and pasting proprietary data into browser-based models. IT and security teams have dealt with shadow software for decades. But shadow agents are different in kind, not just degree.

A shadow SaaS subscription reads data. A shadow agent acts on it.

Right now, in most mid-to-large organizations, engineers are spinning up agents using low-code platforms, LLM frameworks, and automation tools that require nothing more than an API key to get started. Product teams are deploying agents that reach into CRMs, send emails, query databases, and trigger workflows. Individual contributors are building personal agents that operate inside corporate systems because nobody told them not to, and the tools make it frictionless.

None of these agents has a verifiable identity. No birth certificates. No behavioral contracts. No human owners recorded in any governance system. They are, by any meaningful definition of governance, anonymous actors within your infrastructure.

What could go wrong?

When something goes wrong, such as a customer receiving the wrong information, a privileged database being queried in unexpected ways, or a compliance boundary being crossed, the investigation starts from scratch. Which agent did this? Who built it? What was it authorized to do? What was its configuration at the time?

These questions often don’t have answers. Not because the logs are missing, but because the identity was never established. You can’t trace an anonymous actor. You can only observe the damage.

Think about what governance actually requires. When an agent takes an action, you need to know which agent did it. Not which API key was in the request header. Not which service account the call came from. Which specific agent, with a known configuration, operating under a known behavioral contract, owned by a known human being who is accountable for its behavior.

Without that, your audit trail is a log of events with anonymous actors. Your scope enforcement has no subject to enforce against. Your behavioral evaluation is running on something that could be any agent, or a modified version of the agent you think it is, or something entirely different wearing the right credentials.

Identity isn’t a feature of AI governance. It’s the precondition for it. And without a mandatory identity layer, shadow agents aren’t an edge case. They’re the default.

What an API Key Actually Is

When an organization’s answer to “how do your agents identify themselves” is “API key,” what they’ve described is authentication. An API key proves the caller has a secret. It proves nothing about what that caller is, what it’s authorized to do, what behavioral contract it’s operating under, who owns it, or whether the thing using the key today is the same thing that was issued the key last week.

An API key is a secret shared between a service and a caller. It is not an identity.

A JWT is a step better. It carries structured claims. But claims without behavioral context are still incomplete. Knowing that a token was issued to financial-agent-7 tells you the name assigned to that person. It doesn’t tell you the agent’s archetype, its governance zone, its authorized action scope, its compliance preset, or its lineage, whether this agent was derived from another agent, under what conditions, by whose authority.

These aren’t bureaucratic details. They’re the information that governance decisions actually depend on.

The Agent Manifest

There’s a step that has to happen before a birth certificate can mean anything. Someone has to declare what the agent actually is.

This is the problem the .agent package format solves. An open standard for packaging AI agents that includes their capabilities, dependencies, tools, runtime requirements, and behavioral metadata into a portable, inspectable artifact that travels with the agent from development through deployment. Think of it as the agent’s application for identity. Before you can issue a cryptographic certificate binding an agent to a governance context, you need a structured declaration of what that agent is. The .agent manifest provides that declaration in a standardized, machine-readable form.

Without a manifest standard, every team describes its agents differently. Different fields. Different conventions. No consistent vocabulary for capabilities or constraints. Governance systems encounter agents they’ve never seen before and have to infer their identities from behavior, which is exactly backwards. Governance should know what an agent is supposed to be before it observes what the agent actually does.

The .agent package is the pre-governance artifact. The birth certificate is what activates governance. Together, they close the gap between “we built an agent” and “we know what this agent is, and we’ve bound it to a governance context before it takes its first action.” You can learn more about the open standard at agentpk.io.

What a Birth Certificate Is

An Agent Birth Certificate is a cryptographically signed identity document issued to an agent at the moment it’s created. Not when it first receives a request. At creation, before it takes any action.

The certificate carries the agent’s identity, its owner, its behavioral archetype, its governance zone, its authorized scope, and a governance hash that binds the certificate to the specific governance configuration the agent is operating under. It’s signed by the organization’s governance authority using Ed25519; the signature isn’t advisory, it’s verifiable by any system that encounters this agent, without requiring a central authority to be online and consulted.

Every field carries meaning. The archetype tells every downstream system what kind of agent this is and what prior behavioral expectations apply. The governance zone determines which policies govern this agent and which jurisdictional constraints apply. The owner establishes a binding human accountability chain in which a specific person is responsible for this agent’s behavior. The governance hash means that if the agent’s configuration changes, the change is detectable. The lineage field traces derivation. If this agent was spawned by another agent, that relationship is recorded and verifiable.

The certificate doesn’t just identify the agent. It establishes the entire governance context within which the agent operates before it takes its first action.

Authority Is Issued, Not Assumed

Here’s the principle that the birth certificate enforces by design: authority is issued, not assumed.

An agent without a birth certificate operates under the assumption that it can take whatever actions its underlying model decides, constrained only by downstream guardrails. The agent has no declared scope. It has no behavioral contract. It hasn’t been issued authority.

An agent with a birth certificate has been explicitly issued authority. A human, accountable by name, made a decision about what this agent is, what it can do, and the governance context in which it operates. That decision is recorded, cryptographically bound to the agent, and verifiable at runtime.

This matters practically, not just philosophically. A governance evaluation that runs against an agent with a valid, active certificate knows the agent’s trust score at issuance, its behavioral age, its authorized scope, and its governance zone. The evaluation doesn’t have to make inferences. It has ground truth.

A governance evaluation that runs against an anonymous agent is doing something closer to guesswork.

The Certificate Lifecycle

A birth certificate isn’t a one-time stamp. It’s a living document with a lifecycle.

An active certificate can be suspended. If an agent accumulates trust violations, a behavioral anomaly triggers a review, or a human determines that something is wrong, the certificate is moved to suspended. The agent cannot take further actions. A human can reinstate it.

Revocation is permanent. When an agent is decommissioned, when a certificate is compromised, or when the decision is made that this agent should never operate again, the revocation is immediate, recorded, and terminal. The certificate is linked to an immutable revocation record. Any system that checks this agent’s status gets a definitive answer.

Renewal carries lineage. When governance configurations change significantly, the old certificate is retired, and a new one is issued. The new certificate carries a reference to its predecessor. The chain of identity is preserved across the agent’s operational history.

This isn’t bureaucracy. It’s the mechanism that makes an audit trail mean something. Every action in the audit trail is associated with a certificate. Every certificate has a human owner. Every revocation or suspension is timestamped and recorded. The accountability chain is complete and verifiable.

What Governance Looks Like Without It

It’s worth being specific about what you actually have when you skip the birth certificate layer.

You have agents taking actions that are attributed to whatever identifier happened to be in the request context. If that identifier is reused across multiple agent instances, you have no way to distinguish which specific instance of which specific agent version took a specific action.

You have scope enforcement without a subject. A rule that says “this service account cannot take write actions” isn’t agent governance. It’s the service account policy. Agents have behavioral context, trust history, operating zones, and archetypes. Service accounts have none of those things.

You have an audit trail that can tell you what happened. It cannot reliably tell you who did it in any sense that leads to human accountability. When something goes wrong, your incident response starts with “we’re not entirely sure which agent this was.”

You have a behavioral evaluation running against a context that may be incomplete or unverifiable. The evaluation might produce a verdict. That verdict is only as reliable as the identity assumptions underneath it.

Most critically, you have no way to answer the question regulators will ask. Not “did an AI agent take this action” but “which AI agent, operating under which governance configuration, owned by which human being, took this action, and can you prove that?”

Without a birth certificate, you cannot answer that question with evidence. You can answer it with logs and inference, and maybe. That’s not compliance. That’s hope.

The Baseline Requirement

Every element of a serious AI governance framework, including runtime evaluation, interrupt authority, behavioral drift detection, hash-chained audit trails, human escalation, and trust calibration, presupposes a known, verifiable actor.

If you don’t know who your agent is, you can’t govern it. You can run it. You can observe it. You can filter some of its outputs. But governance, in any meaningful sense, requires a subject. An agent with a cryptographic identity, a human owner, a defined scope, and a known behavioral contract.

The birth certificate isn’t the most sophisticated part of the governance stack. It’s the most foundational. Everything else is built on top of it. Without it, you’re not governing agents.

You can’t have a “life” cycle, without first giving your agent a certificate of life.
